These Terms of Business apply to services provided by Lincoln Sunbeds Limited (“we”, “us” or “our”), including sunbed hire, equipment sales, servicing and repairs.
These terms apply to residential and commercial customers (“you”, “your” or “the Hirer”) where they have been made available and properly incorporated into the contract before it is formed. They should be read alongside your invoice, rental agreement and relevant safety instructions.
1. Bookings and Payments
1.1. All bookings are subject to availability and confirmation by Lincoln Sunbeds. Customers must be at least 18 years old to hire equipment.
1.2. Our standard minimum hire period is four weeks unless otherwise agreed. Hire prices and periods are confirmed when booking.
1.3. Payment is due in full upon delivery unless otherwise agreed. Additional hire periods must be agreed and paid for separately.
1.4. Advance bookings may initially be allocated to a delivery week, with the exact delivery date confirmed nearer the time.
1.5. Customers wishing to cancel or amend a booking should contact us as soon as possible. Cancellations are considered individually, taking account of costs incurred and any applicable cancellation rights. Any cancellation charges will be reasonable and legally recoverable.
2. Delivery and Installation
2.1. Customers must provide accurate delivery details and ensure suitable access, sufficient space, adequate ventilation and an appropriate electrical supply.
2.2. Equipment must only be installed and operated in a suitable location in accordance with our instructions and the manufacturer's requirements.
2.3. We reserve the right to refuse installation where we reasonably consider the location, access or electrical supply unsafe or unsuitable.
2.4. Equipment must not be moved, relocated, dismantled or modified without our prior written permission.
2.5. Where delivery cannot be completed due to circumstances within the customer's control, reasonable additional delivery charges may apply, provided these have been disclosed and are legally recoverable.
3. Ownership and Care of Equipment
3.1. All hired equipment remains the property of Lincoln Sunbeds Limited throughout the hire period.
3.2. Customers are responsible for taking reasonable care of the equipment and must not sell, lend, sub-hire, alter or attempt to repair it.
3.3. Equipment should be inspected upon delivery. Any visible damage, missing components or concerns should be reported within 24 hours where reasonably possible. This reporting request does not prevent later reporting of defects.
3.4. Customers may be charged reasonable repair costs for damage caused by misuse, negligence or breach of these terms. Where equipment is lost, stolen or damaged beyond economical repair due to circumstances for which the customer is legally responsible, reasonable replacement costs may apply, taking account of the equipment's condition and value.
3.5. Customers will not be charged for fair wear and tear, pre-existing defects or faults for which they are not responsible.
4. Sunbed Safety and Responsible Use
4.1. Sunbeds emit ultraviolet (UV) radiation, which can cause burns, eye damage, premature skin ageing and an increased risk of skin cancer.
4.2. Customers must read and follow all supplied operating instructions, safety information and recommended exposure times.
4.3. Sunbeds must not be used:
By anyone under 18 years old.
For longer or more frequently than permitted by the supplied instructions.
Without appropriate protective eyewear.
By anyone who has been advised against UV exposure.
Where medication, medical conditions or products may increase UV sensitivity without appropriate medical advice.
If the equipment is damaged, faulty or unsafe.
4.4. Customers must ensure that anyone authorised to use the equipment understands and follows the relevant safety instructions.
4.5. Customers must not tamper with timers, tubes, electrical components or safety features, or use equipment contrary to the manufacturer's instructions.
4.6. Customers must stop using the equipment immediately if they experience an adverse reaction or suspect an equipment fault. Appropriate medical advice should be sought where necessary.
5. Liability, Misuse and Unauthorised Use
5.1. Customers acknowledge the health risks associated with UV tanning equipment and accept responsibility for following the supplied safety instructions and using the equipment appropriately.
5.2. To the extent permitted by law, Lincoln Sunbeds Ltd shall not be liable for injury, loss or damage arising from the misuse of equipment, excessive UV exposure, failure to follow supplied safety instructions or unauthorised use, where Lincoln Sunbeds Ltd is not legally responsible for that injury, loss or damage.
5.3. The Hirer must not permit any third party to use the equipment without prior written consent from Lincoln Sunbeds Ltd. The Hirer remains responsible for ensuring that all authorised users comply with the supplied safety instructions.
5.4. To the extent permitted by law, the Hirer agrees to indemnify Lincoln Sunbeds Ltd against reasonable losses, damages, costs and third-party claims arising directly from the Hirer's negligence, misuse, breach of these terms or unauthorised use of the equipment, except to the extent caused by Lincoln Sunbeds Ltd's own negligence or breach of legal duty. For consumer Hirers, this obligation applies only to losses and costs for which the Hirer is legally responsible and must not impose an unfair or disproportionate liability.
5.5. Customers must take reasonable steps to prevent unsafe or unauthorised use of hired equipment and notify Lincoln Sunbeds promptly of any incident, injury or suspected equipment defect.
6. Faults and Breakdowns
6.1. Any equipment fault or malfunction must be reported to Lincoln Sunbeds promptly. Customers must stop using equipment that appears unsafe.
6.2. We aim to resolve faults as quickly as reasonably possible, usually by repairing the fault or supplying a replacement unit where available.
6.3. Where equipment becomes unusable due to a fault for which we are responsible, we will provide an appropriate remedy, which may include a repair, replacement, hire extension or refund.
6.4. Customers must not attempt repairs or arrange third-party repairs without our permission.
6.5. Where faults or damage result from customer misuse, negligence or unauthorised alterations, reasonable repair or replacement charges may apply.
7. Hire Extensions and Collection
7.1. The agreed hire period is shown on the customer's invoice or rental agreement.
7.2. Extensions must be arranged with Lincoln Sunbeds and are subject to availability. The original rental terms and safety instructions continue to apply throughout any agreed extension.
7.3. Customers must provide reasonable access for collection on the agreed date.
7.4. Where collection cannot take place due to circumstances within the customer's control, additional hire charges at the agreed rate and reasonable collection costs may apply where legally permitted.
7.5. Customers must not deliberately obstruct collection or retain equipment beyond the agreed hire period without our permission.
7.6. All hired equipment remains the property of Lincoln Sunbeds Ltd and must be made available for collection upon expiry or termination of the agreed hire period.
7.7. Any deliberate refusal to return equipment, repeated obstruction of collection or continued retention without our consent may be treated as a breach of contract. We reserve the right to recover the equipment and pursue any reasonable outstanding hire charges, recovery costs or losses legally recoverable.
7.8. Where Lincoln Sunbeds Ltd reasonably suspects that hired equipment has been dishonestly retained, concealed, sold or otherwise unlawfully disposed of, we reserve the right to report the matter to the police and take appropriate legal action to recover our equipment and any associated losses.
7.9. Lincoln Sunbeds Ltd reserves the right to terminate a hire agreement where the Hirer commits a serious breach of these terms, including non-payment, deliberate misuse, unauthorised disposal of equipment or refusal to return equipment. Where appropriate, reasonable notice and an opportunity to remedy the breach will be provided. Upon lawful termination, the Hirer must make the equipment available for collection.
8. Sunbed Sales
8.1. We also supply new, used and ex-hire sunbeds, replacement tubes, parts and accessories.
8.2. Equipment descriptions, condition, prices, payment arrangements and any delivery or installation charges will be confirmed before purchase.
8.3. Any applicable manufacturer's warranty will be explained or provided with the equipment.
8.4. Cancellation and return rights depend on the nature of the purchase, how the contract was made and applicable law. Relevant cancellation information will be provided before the contract is concluded.
9. Servicing and Repairs
9.1. We may provide sunbed servicing, fault diagnosis, repairs, tube replacement and maintenance, subject to equipment suitability and availability.
9.2. Prices and the scope of work will be agreed before work begins wherever reasonably practicable. Any additional chargeable work requires customer approval.
9.3. We will carry out agreed services with reasonable care and skill but cannot guarantee that servicing will identify every existing or intermittent fault.
9.4. We are not responsible for faults caused by misuse, unauthorised modifications, unsuitable electrical supplies or unrelated pre-existing defects, except where we are legally responsible.
9.5. Any warranty on repairs or replacement parts will be confirmed separately.
10. Commercial Hire
10.1. Where equipment is supplied to a business, the business customer is responsible for appropriate staff training, supervision, safe operation and compliance with applicable health and safety requirements.
10.2. Commercial customers must ensure that equipment is operated in accordance with all supplied instructions and relevant legal requirements.
10.3. Any additional commercial hire, installation, servicing or payment arrangements will be confirmed in writing.
10.4. Nothing in these terms transfers to a commercial customer any legal duty that remains the responsibility of Lincoln Sunbeds.
11. Complaints, Privacy and General Terms
11.1. Customers should contact Lincoln Sunbeds promptly regarding any complaint, damage, fault or safety concern, providing relevant booking details and supporting information.
11.2. Personal information will be handled in accordance with applicable data protection legislation and our Privacy Policy.
11.3. These terms, together with the applicable invoice, rental agreement and any specifically agreed written terms, form part of the relevant contract. Any conflict will be resolved in accordance with applicable law.
11.4. If any provision is found to be invalid or unenforceable, the remaining provisions will continue to apply where legally permitted.
11.5. These terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply.
12. Statutory Rights and Liability
12.1. Nothing in these Terms of Business affects your statutory rights or excludes or restricts any liability that cannot lawfully be excluded or restricted, including liability for death or personal injury caused by negligence.
12.2. For business customers only, Lincoln Sunbeds Ltd excludes liability for indirect or consequential business losses and loss of profits to the extent permitted by law and subject to applicable reasonableness requirements.
Please retain your rental agreement and safety instructions for the duration of your hire, including any extension periods.
cUSTOMER ACKNOWLEDGEMENT
Where applicable, by signing the Lincoln Sunbeds Rental Agreement or entering into a contract for the supply of goods or services, the Customer confirms that they have had the opportunity to read the relevant terms and understand their responsibilities.
For hired sunbeds, the Customer also acknowledges the importance of reading and following the operating instructions and safety information supplied with the equipment.
These terms constitute the entire understanding between Lincoln Sunbeds Limited and its clients.
